Criminal law – Criminal lawyer in Slovenia
The role of a criminal lawyer in Slovenia in criminal proceedings in court is primarily dual. On the one hand, it can represent the accused. In this case, we are talking about a criminal lawyer as an attorney counsel in criminal proceedings. On the other hand, it can represent the injured party. In this case, we are talking about a lawyer as a representative of the injured party. In both cases, the lawyer’s main task is to represent the interests of his client and to assist him with his rights and obligations accoriding to the criminal procedure rules (notably the Criminal Procedure Code) – as the main source of criminal law in Slovenia.
The criminal lawyer or attorney counsel in criminal proceedings plays a more difficult role than the representative of the injured party, as he or she is obliged to fight against the prosecutor who has a whole state apparatus behind him. The representative of the injured party does not play such a difficult role in criminal proceedings, as he usually cooperates with the prosecutor and has an interest in convicting the accused. Only in the case of a final conviction of the accused will the damages claim of the injured party in criminal proceedings be successfully resolved.
Criminal attorney counsel in Slovenia
A lawyer in criminal proceedings in Slovenia is usually a lawyer who specializes in criminal proceedings. Everyone has the right to defend himself in criminal proceedings with the assistance of a criminal lawyer in Slovenia. This is also true in pre-trial proceedings, even at the very beginning when the suspect is first contacted by the police. Sometimes defense with an attorney counsel is even mandatory in Slovenia. This is the case when the accused is in custody or when he is prosecuted for serious crimes with the possibility of long term imprisonment. In such cases, the criminal lawyer is provided by the state and we speak of ex officio attorney counsel in Slovenia. The accused may choose another criminal lawyer, but cannot be without one.
